1. Intellectual Property & DMCA Policy
DecoRta respects the intellectual property rights of others and expects the same from everyone who uses our Services. This policy explains how we handle intellectual property matters, including notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA).
2. Our Intellectual Property
The DecoRta name, logo, marks, and all content on our website — including text, images, graphics, photographs, video, audio, and their arrangement — are owned by DecoRta or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, publicly display, or transmit any of this material without our prior written consent. All rights not expressly granted are reserved.
3. Our Products & Production
DecoRta curates home products from a range of suppliers. Product designs, supplier trademarks and licensed materials belong to their respective rights holders. Third-party trademarks, brand names, and designs referenced on our website belong to their respective owners, and their appearance on our website does not imply endorsement of, or affiliation with, DecoRta.
4. Respect for Others' Rights
We do not permit content or products on our Services that infringe the intellectual property rights of others. If you believe that any content on our website infringes your copyright, trademark, or other intellectual property rights, please notify us as described below and we will take appropriate action.
5. DMCA Notice Requirements
If you are a copyright owner (or authorised to act on behalf of one) and believe that content on our website infringes your copyright, you may submit a written notice to us containing all of the following:
• identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list);
• identification of the allegedly infringing material, including the URL(s) of the specific page(s) where it appears;
• your contact information, including your full name, address, telephone number, and email address;
• a statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law;
• a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of the exclusive right that is allegedly infringed; and
• your physical or electronic signature.
Send intellectual property notices through our Contact page or email support@decorta.com with the subject line "IP Notice". Notices that do not substantially comply with these requirements may not be processed.
6. Our Response Process
Upon receiving a valid notice, we will:
• review the notice for completeness;
• remove or disable access to the allegedly infringing material where appropriate;
• notify the party responsible for the material (where applicable) of the removal and provide a copy of the notice.
The affected party may submit a counter-notice if they believe the material was removed in error. If we receive a valid counter-notice, we may restore the material within 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.
7. Misrepresentations
Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing — or that material was removed by mistake — may be liable for damages, including costs and attorneys' fees.
8. Repeat Infringers
We will terminate access to the Services for users who are determined to be repeat infringers of intellectual property rights, where appropriate and in accordance with applicable law.
